Opulence Legacy provides this website and its associated information, digital products, educational content, templates, tools and services, including the Business Ready Toolkit, subject to your acceptance of these Terms of Service and all other policies published on our website.

By accessing our website, creating an account, purchasing the Business Ready Toolkit or using any part of our services, you agree to be bound by these Terms of Service.

These Terms apply to all users of the website, including visitors, customers, account holders, contributors and any person who accesses our products or services.

Please read these Terms carefully before accessing the website or purchasing the Business Ready Toolkit. If you do not agree to these Terms, you must not use the website, create an account or purchase our products or services.

We reserve the right to update, amend or replace these Terms by publishing the revised version on our website. Your continued use of the website or Business Ready Toolkit after changes are published constitutes acceptance of the revised Terms, to the extent permitted by law.

SECTION 1 — ONLINE STORE TERMS

By agreeing to these Terms, you confirm that:

  • Written instructions
  • Graphics
  • Icons
  • Logos
  • Branding
  • Website content
  • Page designs
  • Layouts
  • Product structures
  • Module structures
  • Document arrangements
  • Processes
  • Systems
  • Methods
  • Concepts expressed in protectable form
  • Databases
  • Digital resources
  • Updates and supplementary materials

The purchase of the Business Ready Toolkit does not transfer ownership of any intellectual property to you.

All rights not expressly granted under these Terms are reserved by Opulence Legacy.

2.2 Limited licence

When you purchase the Business Ready Toolkit, Opulence Legacy grants you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the purchased materials for the internal purposes of your own business.

This licence does not permit you to reproduce, distribute, resell or commercially exploit the Toolkit.

Unless Opulence Legacy gives you prior written permission, each purchase may be used by:

  • One registered customer;
  • Through one customer account; and
  • For the customer’s own business purposes only.

The licence may not be transferred, assigned, sublicensed or shared with another person or organisation.

2.3 Prohibition against replication

You may not, directly or indirectly, replicate the Business Ready Toolkit or any part of it.

Without prior written permission from Opulence Legacy, you may not:

  • Copy, reproduce or duplicate the Toolkit or any substantial part of it;
  • Replicate its templates, content, structure, sequence, layout, arrangement, design or presentation;
  • Modify, adapt, translate, rewrite or transform the Toolkit for resale, distribution or publication;
  • Create derivative works based on the Toolkit;
  • Extract content from the Toolkit to create another product or service;
  • Use the Toolkit as the basis for a competing product;
  • Rebrand, white-label or present the Toolkit as your own;
  • Remove or conceal copyright notices, logos, watermarks, trademarks or ownership information;
  • Sell, resell, rent, lease, license, sublicense or commercially exploit the Toolkit;
  • Share, email, transfer or distribute the Toolkit to another person;
  • Publish or upload the Toolkit to a website, social-media platform, file-sharing service, cloud-storage folder, marketplace, learning platform or membership portal;
  • Make the Toolkit available for public or shared access;
  • Print or reproduce copies for resale or distribution;
  • Use Toolkit materials to provide template packs, document bundles or similar products to third parties;
  • Use the Toolkit to develop, market or sell a competing compliance toolkit, business toolkit, document library, online course, membership, training programme or digital resource;
  • Permit an employee, contractor, consultant, partner, customer, family member or any other third party to use your account or access the Toolkit without written authorisation;
  • Circumvent security measures, download restrictions, progress tracking or access controls;
  • Use automated tools to scrape, extract, copy or archive Toolkit content; or
  • Assist another person in doing any of the above.

You may insert your own business information into editable templates for the legitimate internal use of your own business. This permitted personalisation does not give you ownership of the original template or permission to reproduce, resell, distribute or commercialise it.

2.4 Account sharing

Your account is for your personal use only.

You may not share:

  • Your login details;
  • Access links;
  • Passwords;
  • Download links;
  • Saved documents;
  • Course materials; or
  • Any part of the Business Ready Toolkit.

Where account sharing or unauthorised access is detected or reasonably suspected, Opulence Legacy may suspend or permanently terminate access without prior notice, subject to applicable law.

2.5 No artificial-intelligence training or generation

The Business Ready Toolkit and any part of its content may not be used, submitted, uploaded, copied or provided for the purpose of:

  • Training an artificial-intelligence or machine-learning model;
  • Fine-tuning or improving an artificial-intelligence system;
  • Building a private or public dataset;
  • Developing a chatbot, document generator or automated template system;
  • Prompting an artificial-intelligence system to reproduce, imitate or reconstruct the Toolkit;
  • Producing substantially similar templates, guides, courses or digital products;
  • Creating competing content or products using artificial intelligence; or
  • Enabling a third party to perform any of these activities.

You may not upload Toolkit materials to generative artificial-intelligence platforms, document assistants or similar services where doing so may cause the content to be stored, processed, reproduced, used for model development or made accessible to another party.

Any use involving artificial intelligence requires the prior written consent of Opulence Legacy.

2.6 Enforcement

Opulence Legacy reserves the right to investigate suspected infringement or misuse.

Where we reasonably believe that these Terms have been breached, we may:

  • Suspend or terminate your account;
  • Revoke your licence;
  • Disable access to downloads;
  • Cancel access to future updates;
  • Preserve relevant account and access records;
  • Issue a formal demand to stop the unauthorised activity; and
  • Pursue any legal remedies available to us.

Unauthorised reproduction, resale, distribution or commercial exploitation may result in legal action, including claims for damages, an interdict or other appropriate relief and the recovery of legal costs where permitted by law.

Termination of access does not prevent Opulence Legacy from pursuing any additional remedies available under applicable law.

SECTION 3 — THE BUSINESS READY TOOLKIT

The Business Ready Toolkit is a digital educational and business-resource product intended to help entrepreneurs organise and manage aspects of their businesses.

Depending on the package purchased, the Toolkit may include:

  • Editable business templates;
  • Company-compliance documents;
  • Tender-readiness resources;
  • CIPC- and SARS-related guidance;
  • Guides and checklists;
  • Educational videos and tutorials;
  • Business transaction documents;
  • Downloadable resources;
  • Online dashboard access;
  • Customer support; and
  • Additional materials described on the applicable product page.

The specific content included in your purchase is determined by the package selected at checkout.

Features, templates and materials may differ between packages.

SECTION 4 — EDUCATIONAL PURPOSE AND PROFESSIONAL ADVICE

The Business Ready Toolkit is provided for general educational, informational and administrative purposes.

It does not constitute:

  • Complying with applicable legislation and regulations;
  • Meeting submission dates and regulatory deadlines;

  • Keeping your business records accurate and up to date.

Laws, regulations, government procedures and submission requirements may change. You should independently confirm current requirements with the appropriate authority or qualified professional before relying on a Toolkit resource.

SECTION 5 — NO GUARANTEE OF OUTCOMES

Opulence Legacy does not guarantee that purchasing or using the Business Ready Toolkit will result in:

  • Business registration;
  • Approval by CIPC, SARS or another authority;
  • Successful compliance;
  • Tender eligibility;
  • Tender awards;
  • Funding;
  • Contracts;
  • Customers;
  • Revenue;
  • Profit;
  • Business growth;
  • Investment;
  • Certification; or
  • Any other particular result.

Your results depend on several factors outside our control, including the accuracy of your information, the nature of your business, regulatory requirements, your implementation and decisions made by third parties.

Testimonials, reviews and examples on our website reflect individual experiences and do not guarantee that every customer will obtain the same outcome.

SECTION 6 — DIGITAL ACCESS AND DELIVERY

An order is not complete until payment has been successfully processed and accepted.

Changes will not remove any statutory rights you may have.

SECTION 9 — UPGRADES

Where an upgrade option is available, you may be required to purchase the higher package or pay the applicable upgrade amount displayed at the time of upgrading.

Previous payments will only be credited toward an upgrade where this is expressly stated in the applicable offer.

Upgrade prices, eligibility and package differences may change.

SECTION 10 — REFUNDS

Refunds for the Business Ready Toolkit are governed by the Opulence Legacy Return and Refund Policy.

Subject to applicable law, a refund request must be submitted within 7 days of purchase.

Because the Business Ready Toolkit is a digital product, a discretionary refund will generally only be considered where:

  • The request is made within the 7-day period;
  • No more than 10% of the Toolkit has been accessed, viewed, completed, used or downloaded;
  • The customer has not substantially copied, retained, distributed or used Toolkit content; and
  • Valid proof of purchase is provided.

Toolkit usage may be assessed using available information, including:

Course-progression records;

  • Account activity;
  • Login history;
  • Download history;
  • Module completion;
  • Resource access; and
  • Other technical records associated with the customer’s account.

Where more than 10% of the Toolkit has been accessed, viewed, completed, used or downloaded, a discretionary refund may be declined because a material portion of the digital content has already been supplied.

Nothing in this section limits any non-excludable rights or remedies available to a consumer under applicable South African law.

SECTION 11 — TECHNICAL ISSUES

If you experience a technical problem, you must give Opulence Legacy a reasonable opportunity to investigate and resolve it.

Before requesting a refund based on a technical issue, please contact us and provide:

  • Your full name;
  • Order number;
  • Account email address;
  • A description of the problem;
  • Screenshots or screen recordings where possible;
  • The device and browser being used; and
  • Any error message received.

We are not responsible for access problems caused by:

  • Incorrect customer information;
  • Forgotten passwords;

  • Internet failure;
  • Browser settings;
  • Customer-side software;
  • Full email inboxes;
  • Spam filters;
  • Third-party outages; or
  • A customer’s failure to follow access instructions.

  • You have shared your account;
  • You have reproduced or distributed Toolkit content;
  • You have attempted to replicate the Toolkit;
  • You have used Toolkit content to build a competing product;
  • You have used Toolkit content for unauthorised AI training;
  • Your account is connected to fraudulent activity;
  • Your use threatens the security of the website; or
  • Suspension is required by law.

Where access is terminated because of a material breach, you must stop using the Toolkit and delete any unauthorised copies in your possession or control.

Clauses relating to intellectual property, liability, indemnification, dispute resolution and governing law survive termination.
