LEGAL NOTICE: INTELLECTUAL PROPERTY PROTECTION

BUSINESS READY TOOLKIT

The Business Ready Toolkit, including all templates, documents, tutorials, videos, guides, checklists, written content, graphics, layouts, systems, structures, downloadable resources and supporting materials, is proprietary content belonging to Opulence Legacy.

The Toolkit is protected by applicable South African copyright, intellectual-property and contract law. Copyright protection may apply automatically to original literary, artistic and other eligible works once they have been created in material form.

Purchasing or accessing the Business Ready Toolkit gives the customer only a limited, personal, non-exclusive, non-transferable and revocable licence to use the materials for the internal purposes of their own business.

No ownership rights are transferred to the customer.

STRICTLY PROHIBITED CONDUCT

Without the prior written consent of Opulence Legacy, no person may directly or indirectly:

Copy, reproduce, duplicate or replicate the Business Ready Toolkit, whether in full or in part.
Recreate or imitate its templates, wording, structure, layout, sequence, presentation or arrangement.
Modify, rewrite, adapt, translate or rebrand its materials for distribution or commercial use.
Sell, resell, licence, sublicense, rent, lease or otherwise commercially exploit the Toolkit.
Share the Toolkit, login credentials, access links, downloaded files or course materials with another person or business.
Publish, email, transfer or upload Toolkit content to any website, cloud-storage folder, file-sharing platform, online marketplace, learning platform or social-media service.
Remove, alter or conceal any Opulence Legacy branding, copyright notice, watermark or ownership information.
Use the Toolkit to create a competing compliance toolkit, template pack, document bundle, course, membership, consulting product or other digital resource.
Use Toolkit content to provide documents, templates or resources to third-party customers for resale or commercial gain.
Use automated software, scraping tools or extraction systems to collect or reproduce Toolkit content.
Upload the Toolkit to an artificial-intelligence platform or use it to train, fine-tune, develop or improve an artificial-intelligence or machine-learning system.
Use artificial intelligence to reconstruct, imitate or create a substantially similar version of the Toolkit.
Assist, encourage or permit another person to perform any prohibited act.

Customers may personalise editable templates by inserting their own business information for legitimate internal use. This does not permit the reproduction, distribution, resale or commercial exploitation of the original template.

CONSEQUENCES OF UNAUTHORISED REPLICATION

Any unauthorised reproduction, adaptation, distribution, publication, resale or commercial use of the Business Ready Toolkit may constitute copyright infringement and a material breach of the customer’s agreement with Opulence Legacy. Under the Copyright Act, infringement generally occurs when a person performs, or causes another person to perform, an act reserved for the copyright owner without permission.

Where Opulence Legacy reasonably suspects unauthorised access, sharing, copying or replication, it reserves the right, subject to applicable law, to take immediate action, including:

Suspending or permanently terminating the responsible account.
Revoking the customer’s licence to use the Toolkit.
Disabling access to all modules, documents, downloads and future updates.
Rejecting any refund request arising from a material breach.
Requiring the immediate deletion, destruction or surrender of unauthorised copies.
Issuing a formal cease-and-desist demand.
Requesting the removal of infringing material from websites, platforms, marketplaces, hosting providers and social-media services.
Preserving login, download, progress, device and access records as evidence.
Instituting legal proceedings to stop further infringement.
Claiming damages, a reasonable royalty, legal costs and any other relief available under applicable law.

Civil remedies under South African copyright law may include court orders restraining continued infringement, damages or a reasonable royalty, depending on the circumstances.

Certain knowing commercial dealings in infringing copies—including making copies for sale or hire, selling them or distributing them for trade—may also constitute a criminal offence under the Copyright Act. The penalties stated in the Act may include fines, imprisonment or both, depending on the offence and whether it is a first or subsequent conviction.

ACCOUNTABILITY FOR THIRD-PARTY USE

The registered customer is responsible for keeping their account credentials and downloaded materials secure.

Allowing another person, employee, contractor, partner, consultant, relative or business to access or reproduce the Toolkit may be treated as unauthorised sharing, even when the customer does not receive payment.

A customer may also be held responsible where they knowingly enable, facilitate, encourage or benefit from the unauthorised reproduction or distribution of Toolkit materials.

MONITORING AND ENFORCEMENT

Opulence Legacy reserves the right to use reasonable technical and administrative measures to identify potential misuse, including monitoring:

Account login activity.
Course progression.
Document access.
Download activity.
Multiple-device or unusual-location access.
Repeated access attempts.
Unauthorised online publication or resale.

Monitoring will be conducted subject to Opulence Legacy’s Privacy Policy and applicable data-protection law.

Opulence Legacy’s failure to act immediately against an infringement does not constitute permission, consent or a waiver of its rights.

REPORTING UNAUTHORISED USE

Suspected copying, sharing, resale or replication of the Business Ready Toolkit should be reported immediately to:

FINAL WARNING

The Business Ready Toolkit may not be copied, shared, reproduced, resold, rebranded, reconstructed or used to create a competing product in any form.

Unauthorised use may result in the immediate loss of access without refund and may expose the responsible person or business to civil proceedings and, in qualifying circumstances, criminal consequences under South African law.
